UGC norms for NET declared illegal by Kerala High Court

The Kerala High court today declared
as illegal the new norms fixed by UGC for the National
Eligiblity Test (NET) for college and university lectureship.
"The power of UGC ought to have been excercised in a
proper, fair and reasonable manner," Justice T R Ramachandran
Nair held while allowing a batch of petitions challenging the
new norms.
The court held that fixing of higher aggregate marks for
three categories, that too just before the announcements of
results, cannot be justified as the same was "not supportable
by law".
It also declared that all those who have obtained minimum
marks prescribed in the notification have cleared NET and
appropriate follow up action be taken to issue certificates to
them within one month.
By changing the standards at the final stage and just
before declaration of results, "it can be definitely be seen
that it affected adversely the expectations of a large number
of candidates", the court said.
As per the new norms, candidates in general category have
to score aggregate of 65 per cent in all three NET papers to
be eligible for college and university lectureship while OBC
candidates need to score 60 per cent and SC/ST candidates 55
per cent.
Previous norms had stipulated that the general category
had to get 40 per cent in Paper I and Paper II and 50 per cent
in Paper III. In case of OBC, SC/ST students, the qualifying
percentage was 35, 35, 45 and 35, 35, 40 in all three papers.
The declaration of new norms had been opposed by students
who appeared in the examination in June this year.

The court decision is a great relief to too many NET aspirants. But this will cause a steep hike in the bribe for lecturer post in Kerala aided colleges ( heard already it's already above 15 lakh). Did anyone filed case against the discrimination in eligibility criteria between General, OBC and SC-ST categories ? OBC candidates need about 15% ( 5 + 5 + 5 ) less marks than General category people to pass in this exam. And SC-ST needs around 20 % less. If things are going in this way, even MBBS pass marks will be decided based on the caste & religion.

I welcome the judgement given by the court cz ugc failed to clear it before conducting the exam. It's unfair to keep some in dark as the corporate world's hide in an * mark. I want to say that one of my friend mentioned that OBC need 15% and SC/ST candidates 20% less marks to qualify. My dear friend it is just 5% marks as you have to 15/3=5%. Please don't try to make small thing big.

So, UGC is itself failed in the test conducted by the hon'ble court. I think UGC is also making its standard towards a ABZ (A Big Zero). Universities & Colleges are asking for faculties with Ph. D only & they are not even writing a word on NET. UGC should change its acting by making a more clear criteria of passing this NET & well before-hand. More over, it should make NET mandatory to pursue Ph. D. & entry in the univ/college teaching.

[!User Complaint!] UGC should be decide either before the notification of Exam or in case of next time exam,,,, this time UGC should follow the pre-exam criteria and now it should be consider the court's decision in favor of the aspirant ....should give a new supplementary result and qualify those, who score the pre-exam criteria (marks).....its a right of the aspirants. thanks

Dear Friends, I would like to apologize u all for my harsh comment, as per the UGC instructions given at the time of June 2012 NET / JRF attempt. it was clearly mentioned if u get minimum qualifying marks u candidature will be considered for the final list and the award of JRF as well as lectureship will be done by UGC committee will be final, according to me the qualifying criteria has never changed even at the declaration of results, so if any one having UGC June 2012 instructions to candidates kindly go thorough the 13th instruction carefully............ with all due respect to Kerala high court decision, i don't think so UGC will stay quiet with this verdict. it may refer supreme court bench for the same.

infact,by mentioning that 40,40,50 and 50 percent of all three papers for general on one hand and by leaving the final criteria open ended on their discretion,ugc declared no critaria for qualifying the exam of ugc net june,2012...its immmaterial for ny aspirant to have prior notice of qualifying marks but what matters is that which cut off should they target so that they may be declared passed..actually this was ambigious and misguiding and ugc didnt declared nything finally till they announced the result...its a clear case improper use of power and of discretion which was necessary to be used reasonably having noticing the candidated previously in clear terms..........

i am one of those aspirants who suffered.. got a big relief.. but i want to knw is this stay only for kerala or whole of India ??? plzzzzz some one clear this....

hw do we get abt claim our righteous passing eligibility . i got a pass in all thre papers....n lost by less than one %...is it right on part of ugc to declare at the last minute the real eligibility criteria....then why why say we have to pass minimum a particular mark for each papet...what atrocit..y

I also cleared all three papers. will i be declared qualified? and when? I dont belong to Kerala. Will it be applicable all over India atumatically ? or sould i knock the door of Court?

[!User Complaint!] It is the right of students to seeks the justice, The Hon'le Apex Court and The kerala high court has given the right and constitutional verdict b'coz UGC could not alter the policy arbitrarily which is not supported by the law of land .I hope this is the spiritual and mental relief for UGC aspirants, We are also hopeful that the News will be follow up .
