Kapil murder: Production warrant issued

The Kerala High Court on Thursday issued a production warrant to the Superintendent, Central Prison, Thrissur, to produce before the court the five accused who are convicted in the Kapil murder case.
A Division Bench comprising Justice M Sasidharan Nambiar and Justice C T Ravikumar ordered that they be produced on November 30 for an interrogation as several facts were omitted by the Ernakulam Additional Sessions Court during the case trial. The Bench issued the order on an appeal filed by the five accused against the sentence imposed by the Sessions Court.
The accused are Muhammed Sali of Cherthala, Shibu of Arookutty, Sabin Kumar of Peravoor, Shahul Hameed of Kakkanad and Joby of Karumaloor.
The court said that the questions regarding certain incriminating facts in the report of the Forensic Science Laboratory after examining the material evidence, were not put across to the accused at the time of interrogation under Section 313 of the Code of Criminal Procedure.
