HC stays collection of FSA charge in power bills

In a major development, justice CV Nagarjuna Reddy of the AP High Court on Tuesday stayed collection of Fuel Surcharge Adjustment (FSA) from power consumers for 2009-10.
The judge passed the order after allowing a batch of writ petitions by various industrial power consumers challenging the APERC (Andhra Pradesh Electricity Regulatory Commission)’s order permitting power distribution companies (Discoms) to collect FSA for the years 2008-09 and 2009-10.
The orders of the APERC are not enforceable till the Supreme Court decides the matter which was pending before it. If the apex court decides in favour of Discoms then they are entitled to recover the arrears from consumers, the judge said.
He directed the power utilities that the amount already collected from consumers should be adjusted in future monthly bills.
The petitioner companies had earlier questioned the orders of the Discoms after the APERC allowed a petition filed by the Discoms condoning delay in seeking permission to collect FSA for 2008-09.
Earlier, a division bench of the AP High Court declared that the APERC had no power to condone such delay and any claim by Discoms after 30 days period of every quarter stands forfeited, the high court said. Then the Discoms approached the Supreme Court and the case is still pending.

Even after High Court order of discontinuation of collecting Fuel Surcharge Adjustment (FSA) from consumers, the APERC is still following the path they decided. 1. The Electricity department has not adjusted the collected FSA amount from the present bills. 2. In Oct-2012 billing again the FSA is charged to the consumers. I think, APERC has taken oath same like Ministers not to follow High Court orders. When the case is still pending in Supreme Court then how can APERC again charge FSA in Oct-12 billing. Please clarify.

Even for December month they charged FSA for me instead of adjusting the old amount in the present bill.may be we have to lodge a complaint in consumer forum.

I Agree with Rohit. They have again started collecting FSA. When government itself violets court orders how they expects civilians to follow them.

As supreme court has not been ordered to charged to the fsa to the customer to the electricity department, how they have charge the same to the consumer. Please tell me whether i should pay the same or not Regards SAJID 9052796465

I agree with Rohit. When government itself violets court orders how they expects civilians to follow them. I Think we should pay only electricity bill not any other charges -FSA. last month we paid FSA charges but again this month no. I 'm not ready to pay.

Yes, I agree with Rohit and Sajid. Any individuals cannot afford the time and money to file a case and fight against Govt. There should be something like consumer forum to help the common people. There should be right to consumers to hold the bills without fine/late payment charges if any orders are pending in the courst, like instead of paying before and reverting back which happened in June 2012 based on the orders from High Court Govt. There is no honesty in politics and they squeezing as much as from pepole. The Court also acts fast to decide whether to charge the customer and how much tax can be levied, but not so fast to recover from politicians who earned by making scams. Start supporting the parties like LokSatta (AP) and India Against Corruption (IAC) so that their policies at least can give some relief to the common people and corrupting India. To Sajid, you need to pay at least partial bill (if possible) excluding FSA to avoid disconnecting and additional charges.
